JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 22.2.2017 passed in Cr.Misc.No. 7181 of 2017 with a direction to learned trial court to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that period of nine months has expired and large number of witnesses are yet to be examined and petitioner is in custody since 29.7.2016 only on the basis of suspicion.

Heard learned APP and perused the report, from which it appears that 14 witnesses are still to be examined. Having heard both sides and in view of facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five

No.7133 of 2018 (3) dt.28-02-2018 2/2 thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Aurangabad, in connection with Sessions Trial No. 36 of 2017, arising out of Tandwa P.S.Case No. 31 of 2010, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in disposal of trial and appear before the court as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
