JUSTICE ARUN KUMAR ORAL ORDER 02-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Telhara PS Case No. 141 of 2017 registered under Sections 148, 149, 323, 337, 338, 307, 302, 504 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that on the issue of construction of drainage in the line the accused persons assaulted the informant side and one Sudhir Kumar alias Bablu shot at Dhiraj Kumar causing his death and the petitioner Nandkeshwar is said to have given iron rod blow which caused injury on the hand of the informant Learned Counsel for the petitioner submits that both sides are agnates living in the neighbour-hood, there is case and counter case between both sides and the petitioner also sustained injuries in the free fight between the two sides. However the allegation of making firing and killing the deceased is against Sudhir @ Bablu and other persons who opened firing on Chandan Kumar are other coaccused, Lalan Singh and Vinay Singh.
Similarly situated co-accused Ramashray Singh has been admitted to bail, however police has submitted charge-sheet and the petitioner is a 85 years old man.
Patna High Court Cr.Misc. No.6147 of 2018 (2) dt.02-02-2018 Having considered the said facts and circumstances, the petitioner, namely, Nandkeshwar @ NaNDKESHVAR Singh @ Nandkeshwar Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar Singh, Judicial Magistrate, lst Class, Hilsa (Nalanda) in connection with Telhara PS Case No. 141 of 2017.
