The petitioner is in custody in connection with Mahila (Motihari) P.S. Case No.9 of 2014 (GR Case No.217 of 2014) for the offences punishable under sections 341, 342, 323, 498A, 504, 506, 307 and 379/34 of the Indian Penal Code. The FIR charges the petitioner and his all family members of causing torture and mental harassment to the informant who has appeared through counsel Mr. Vijay Shankar Shrivastava.

The anticipatory bail moved by the petitioner in Cr. Misc. No.44697 of 2014 in absence of any compromise was disposed of requiring the petitioner to obtain regular bail which has been rejected by the court below hence this application. I have heard learned counsel for the parties and perused the records.

Patna High Court Cr.Misc. No.50633 of 2015 (2) dt.10-11-2015 The FIR charges the petitioner and his family members of causing physical injury and mental harassment to the informant and stands supported by the evidence collected during investigation. It is perhaps on this count that the regular bail was rejected by the court below.

Mr. Shrivastava, learned counsel appearing on behalf of the informant again makes a plea for resolution of the dispute and restoration of matrimonial harmony but considering that since after the institution of the FIR, at every stage of the proceedings, the resolution has failed, the only observation this Court can make is to permit the informant to raise her grievance and renew her prayer before the appropriate forum for the relief of maintenance etc.

However, considering the nature of allegations and the fact that the petitioner has surrendered to the custody of the court, let the petitioner, namely, Shashi Ranjan Singh be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Mahila (Motihari) P.S.
