Mr.Rajiv Nayan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-07-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Jale P.S. Case No. 109 of 2018, registered under Sections 186, 187, 188 and 409 of the Indian Penal Code. The accusation is that petitioner being the ExSecretary of Matasyajivi Co-operative Society, Jale Block, did not hand over the records of the committee to the newly elected Secretary in spite of direction given by District Co-operative Officer, Darbhanga.

Learned counsel for the petitioner submits that, in fact, in election, Shivji Sahni was elected as new Secretary and he has been removed but in the meantime, direction was given

Patna High Court CR. MISC. No.46802 of 2019(2) dt.30-07-2019 2/2 by the Registrar, Co-operative Societies, Bihar, Patna to hand over the registers to newly elected Secretary on 16.01.2019 but the same was assailed in C.W.J.C. No. 2700 of 2019, in which, petitioner is respondent no. 6 and the aforesaid order dated 16.01.2019 was stayed vide order dated 18.06.2019 and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Jale P.S. Case No. 109 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
