In this case serious allegation has been made against the petitioner to commit rape of 11 years of dumb girl and that was the reason for recording the statement of the mother of the girl. The girl was dumb has been recorded by the Court below, which cannot be disbelieved and so much so that the lady doctor has also reported some violence in the private part of the girl.

In such view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, this application is rejected (Shivaji Pandey, J) pawan/- U
