JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In the first information report, the informant claimed himself to be eye witness of the alleged occurrence and stated that one, Munshi of Munshi Singh and some unknown persons were assaulting the deceased and in course of investigation, for the first time, at paragraph-9 of the case diary, one witness stated that Munshi Singh had also participated in the alleged crime. The statement of aforesaid witness was recorded in the year, 2012 whereas; the alleged occurrence had taken place in the year, 2009. On the basis of aforesaid statement, the police proceeded ahead and detected that the nickname of the petitioner is Munshi Singh and accordingly, petitioner has been made accused in this case.
