Sri Ram Anurag Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 07-05-2018 Heard Sri Birendra Kumar, learned counsel for the petitioner and Sri Ram Anurag Singh, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 8.7.2017 in connection with Gardanibagh P.S. Case No. 178 of 2017 registered for the offence under Section 379 of the Indian Penal Code , 1860, has prayed for grant of bail.

Learned counsel for the petitioner at the very outset submits that other two accused almost in similar circumstances have been granted bail by this Court vide Cr. Misc. No. 22325 of 2018 and Cr. Misc. No. 22916 of 2018.

Learned Additional Public Prosecutor has opposed the prayer for bail, however, he was not in a position to dispute the fact that other two accused persons have been granted bail.

Patna High Court Cr.Misc. No.27362 of 2018(2) dt.07-05-2018 2/2 Considering the period of custody as well as the fact that other two accused almost in similar circumstances have been granted bail, there is no reason to further detain the petitioner.

Let the petitioner Chhotu Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIV, Patna / concerned court in connection with Gardanibagh P.S. Case No. 178 of 2017. (Rakesh Kumar, J) praful/- U T
