Petitioner being husband of the informant is languishing in jail custody since 1.9.2015 in a case registered under sections 366A, 498A, 307, 504 and 120B of the Indian Penal Code. According to the prosecution case itself, informant was taken away by the petitioner on 13.11.2013 and after that petitioner solemnized his marriage with the informant but later on, petitioner and his family members started torturing her and she was not allowed to enter in the house of the petitioner.

Learned counsel for the petitioner drew my attention towards the impugned order and submitted that the petitioner is still ready to keep the informant with full honour and dignity and it is the informant who does not want to lead her conjugal life with the petitioner which is evident from the observations given by learned

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri S.C. Kumar, Judicial Magistrate, Ist Class, Nawada/ concerned court in Warasaliganj P.S. Case no. 235/2015.
