JUSTICE ARUN KUMAR ORAL ORDER 27-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.12.2017, seeks bail in Dagarwa PS Case No. 203 of 2017 (Special Case No. 22 of 2017) registered under Sections 8, 20(b)(ii)(c ), 25 and 29 of the NDPS Act.

The allegation in brief is that the petitioner was found boarding scorpio vehicle alleged to have been escorting a truck carrying huge quantity of ganja.

Learned Counsel for the petitioner submits that the petitioner's vehicle was moving ahead the truck at that point of time, the police merely on suspicion has apprehended the petitioner, no incriminating article has been recovered from the scorpio vehicle, similar situated another co-accused also moving on the said scorpio vehicle namely Subodh Kumar has been admitted to bail by this Court vide Cr.Misc. 15777 of 2018, moreover this petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Shiv Kant Roy @ Srikant Roy is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.25907 of 2018 (2) dt.27-04-2018 satisfaction of Special Judge, NDPS Act -cum- Sessions Judge Purnea in connection with Dagarwa PS Case No. 203 of 2017 (Special Case No. 22 of 2017) with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner; and (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
