ANJANA MISHRA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are the mother, brothers and father of the Takli Devi who is alleged to have friendly terms with the daughter of the informant and are apprehending their arrest in connection with a case registered for the offences punishable under Sections 363, 366/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that admittedly the girl had left her home to attend call of nature. Thereafter, some unnatural sound was heard and the girl disappeared. He submits that only on account of the fact the daughter of petitioner
Patna High Court Cr.Misc. No.3581 of 2016 (2) dt.18-02-2016 P2/2 No. 1 and 4 and sisters of petitioner No. 2 and 3 were on friendly terms with the informant's daughter, the informant has lodged the this case against the petitioners purely on suspicion. Considering the nature of allegation made and that save and except suspicion, there is no further material to implicate the petitioners, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned SubDivisional Judicial Magistrate, Bhagalpur in connection with Shahkund P.S. Case No. 179 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
