The petitioner seeks pre-arrest bail in connection with Karja P.S. Case No. 196 of 2018 for the offences alleged under Sections 341, 323, 324, 325, 326, 307, 504, 506, 379 and 37 of the Indian Penal Code.
The accusation is that in the morning of 27.09.2018, informant, Deepak Kumar, was at his shop he received information from his house that bicycle of a baby has been stolen from the door of the neighbour and informant was also instructed to give the information in that regard. Thereafter, the informant gave the information to the grand-father of the girl due to that reason petitioner, Sujit Satyam, his mother, Sunita Devi, sister, Shubham Kumari and brother, Vishwajeet Satyam, started to abuse the informant and others and Sujit Satyam and

Thereafter, the informant also received injury on his right leg, knee and left ear and also in the thumb of left hand. They also snatched Rs.23,400/- from the pocket of the informant.
Learned counsel appearing for the petitioner submits that the petitioner and informant are gotia and due to some dispute hot talk exchanged regarding which Complaint Case No. 1600 of 2018 is also lodged by Sunita Devi, mother of the petitioner. Further, submission is that while it is alleged in the first information report about receiving several injuries by informant, but, only two injuries were found on the person of the informant, one injury found on the fore-arm is of simple in nature whereas other injury, i.e., lacerated wound over knee both sides 4" x 1/6" x SD over the anterior part of the head was detailed as grievous in nature by the doctor on the basis of CT Scan, showing the fracture of left frontal parietal bone, but, CT Scan, which is of Maa Janki C.T. Scan Centre, Bairiya Golambar, Muzaffarpur, no fracture injury was shown. Petitioner has no criminal antecedent.
Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

No.47135 of 2019(2) dt.30-07-2019 3/3 Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Karja P.S. Case No. 196 of 2018 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, II, West, Muzaffarpur, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
