The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. The FIR of the occurrence of robbery is against unknown.

Submission is that though a mobile phone and Rs.8,000/- was recovered from the possession of the petitioner but that was not the looted article, which would be evident from the seized mobile and the mobile which was looted. The petitioner is in custody since 19.08.2017. He was never put on Test Identification Parade. He is a man of clean antecedent. The investigation of the case is already complete and petitioner is

Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Cheriya Bariyarpur P.S. Case No.125 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
