Petitioner seeks bail in Warsaliganj P.S. Case No.96 of 2016 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the First Information Report.
It is alleged in the written report that son of the informant had gone to attend call of nature, but he did not return. Elder brother of the informant had gone to Narpur Bahiyar and he saw dead body of his son lying in the Moong crop field.
Petitioner is not named in the First Information Report. It is mentioned in the impugned order that during
Patna High Court CR. MISC. No.47367 of 2019(2) dt.06-08-2019 2/2 investigation name of this petitioner has come in para 48 of the case diary.
Counsel for the petitioner submits that name of the petitioner has come merely on suspicion. Petitioner is in custody since 06.06.2019.
Counsel for the petitioner further submits that coaccused, Anil Chaudhary, has already been granted regular bail by co-ordinate Bench of this Court by order dated 28.08.2017 passed in Cr. Misc. No.21791 of 2017.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ-7, Nawada, in connection with Warsaliganj P.S. Case No.96 of 2016, subject to the condition that both the bailors shall be close relative of the petitioner.
