JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 This application, for grant of anticipatory bail, arises out of Warsaliganj P.S. Case No. 96 of 2016, disclosing offences under Sections 302, 201/34 of the Indian Penal Code. Prosecution case is that son of the informant had gone to attend the call of nature but he did not return. Thereafter, his elder brother went towards Narpur Bahiyar and saw that the dead body of son of informant was lying in the field and informant suspected the hands of petitioner and others in the murder of his son.
Submission of learned counsel for the petitioner is that he is not named in the F.I.R. and even during investigation, nothing has come against the petitioner and further in the supervision note also, nothing has come against the petitioner rather it has come that due to love affair between the son of
Patna High Court CR. MISC. No.49121 of 2019(3) dt.08-11-2019 2/2 informant and sister of the co-accused, the deceased was done to death and, thereafter, the dead body was recovered. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. - VII, Nawada, in connection with Warsaliganj P.S. Case No. 96 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
