2. The petitioner is in judicial custody in connection with Patrakar Nagar P.S. Case No. 365 of 2023 for the offence punishable under Sections 307, 326, 332, 353, 120(B) of the Indian Penal Code and 27 of Arms Act lodged on 20.05.2023 by the informant, Ramawatar Prasad.

3. As per the prosecution story, the Police alleged that while on patrolling duty, it intercepted a motorcycle who returned fire causing injury to the policemen which resulted into the FIR.

4. Subsequently, the investigation took place and the petitioner was picked up and from the records/case diary, the

5. Though the learned counsel for the petitioner tried to impress upon this Court about the innocence of the petitioner, a perusal of the para-3 would show that he has criminal antecedent of the same nature as also under section 302 of the IPC.

6. Considering the allegation that has come against the petitioner coupled with the fact that he has criminal antecedent, for the present, this Court is not inclined to extend him the privilege of bail which is accordingly rejected. (Rajiv Roy, J) Ravi/- U T
