JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offence punishable under sections 323, 341,406, 420, 467, 468, 384, 504, 506, 34 of the IPC. As per the prosecution case, four persons including the informant had jointly purchased a Poklen machine worth Rs. 50 lacs in the name of co-accused, Kailash Yadav. They had taken loan from a financer. It is alleged that upon repayment of loan to the financer, the accused persons stopped payment to the informant and one Pramod Choudhary the share of profit arising out of use of the machine. The only allegation against the
Patna High Court Cr.Misc. No.32370 of 2014 (2) dt.21-01-2015 2/2 petitioner is that the said machine is kept at the site of this petitioner, who is a contractor. Allegedly, the petitioner assaulted the informant and other persons when they wanted share in the profit arising out of use of the machine.
Learned counsel for the petitioner submits that the offences, as alleged, are not made out against the petitioner. He also submits that the petitioner has no criminal antecedent. In view of above, the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be released on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Birpur, Supaul in Birpur (Bhimnagar) PS case No. 01/2014, subject to condition as laid down u/s 438(2) of the Code of Criminal Procedure.
