JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324 and 307/34 of the Indian Penal Code and section 27 of the Arms Act. It is alleged that the petitioner and co accused Sukesh Yadav abused the father of the informant, thereafter assaulted the informant. It is specifically alleged that petitioner shot fire causing injury on the head of the informant. Co accused Sukesh Yadav also fired but it did not cause any injury.
It is submitted by the learned counsel for the petitioner that the informant received only one sharp cut injury on the head and no fire arm injury has been found on the person of the informant. The injury report is Annexure 2 to the petition.
Patna High Court Cr.Misc. No.2837 of 2016 (2) dt.19-01-2016 2/2 Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that the informant retracted from the initial version and has filed a petition to that effect before the learned court below. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Khagaria in connection with Parbatta P.S. Case No.174 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
