JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 This is an application for grant of anticipatory bail in connection with Barhaiya P. S. Case No. 59 of 2019 disclosing offences under Sections 302, 201, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The dead body of the brother of informant was found on the railway track and he suspects the hands of several accused persons including the name of the petitioner. Submission of the learned counsel for the petitioner is that except suspicion there is nothing against the petitioner. Even during the investigation it has come on record that while the deceased was in prison, he has a quarrel with one Gaurav Singh and he might have killed him.

Heard learned A.P.P. as well as learned counsel for the informant, who has opposed the prayer for anticipatory bail of

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Barhaiya P. S. Case No. 59 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate in the investigation and appear before the police as and when required.
