JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341/323/354/504/506 of the Indian Penal Code.

Prosecution case is that the petitioner after executing the bond before the learned court below in connection with Parihar P.S. Case No.27/2015 registered under sections 498A/34 of the Indian Penal Code while taking the informant to her matrimonial house he made assault to her when mother and sister of the informant came to rescue they were also assaulted. It is submitted by learned counsel for the petitioner that in pursuance to the order passed in Criminal Miscellaneous No.31220/2015 the petitioner was ready to keep the informant

Patna High Court Cr.Misc. No.2901 of 2016 (2) dt.25-01-2016 2/2 with dignity and honour but the informant herself not ready to go to the matrimonial house and consequently the petitioner filed a petition before the learned court below. For the occurrence of 08.09.2015, the present case has been lodged on 08.09.2015. Considering the delayed lodging of the case, the relationship between the petitioner and the informant and filing of the petition by the petitioner before the learned court below at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Dumra P.S. Case No.236/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
