Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 20.6.2017 passed in Cr. Misc. No.23758 of 2017 with a direction to the learned trial court to conclude the same within a period of seven months, however, submission of the learned counsel for the petitioner is that up-tillnow not a single witness has been examined and the petitioner is languishing in jail custody for more than one year. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the learned trial court that if no substantive progress is made in this case, learned trial court shall release the petitioner on

Patna High Court Cr.Misc. No.11521 of 2018 (2) dt.07-03-2018 2/2 bail to his own satisfaction.

With the aforesaid observation, this application is disposed of.
