Petitioner is apprehending his arrest in connection with Bhagwanpur Hatt P.S.Case no.153 of 2017 dated 5.7.2017 , registered for offences punishable under Sections 354(A) and 379 of the Indian Penal Code.
Allegation against the petitioner is of entering into the house of the informant, tried to misbehave with his minor daughter and on hulla, he fled away leaving his sandal and mobile.
Submission of the learned counsel for the petitioner is that as a matter of fact between the family of the petitioner and the informant there is dispute with respect to safety tank and due to which he has been falsely implicated in this case
Patna High Court CR. MISC. No.47700 of 2019(2) dt.31-07-2019 2/2 and his father has also lodged a case before the Officer Incharge, Bhawannpur Police Station on 5.5.2017 and the present case has been filed on 5.7.2017. He is a student of Engineering and he has been falsely implicated in this case. Heard learned A.P.P. and the learned counsel for the informant, who has opposed the prayer for bail on the ground that the petitioner is named in the FIR and there is allegation of trying to misbehave with the minor girl of the informant. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.
25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM -II, Siwan in connection with Bhagwanpur Hatt P.S.Case No.153 of 2017 dated 5.7.2017, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With the above direction, this application is allowed.
