2. The petitioner apprehends his arrest in connection with Kursela P.S. Case No. 66 of 2024 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Allegation against the petitioner is that he along with other co-accused persons are involved in the illicit business of liquor. Total 165 liters of country made wine have been recovered from the gallons left by the accused persons and one co-accused Chaitu Singh was apprehended on spot and other accused persons including petitioner fled away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.52330 of 2024(2) dt.19-07-2024 2/2 present case only on the basis of suspicion and except the disclosure of Mahal Chaukidar, there is no material against the petitioner. Petitioner has no criminal antecedent. Similarly situated co-accused namely, Rajesh Kumar @ Rajesh Mandal has already been granted anticipatory bail by this Court vide order dated 03.07.2024 passed in Cr. Misc. No. 41182 of 2024. Petitioner undertakes to cooperate in the investigation and trial of this case.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Incharge Additional District and Sessions Court-cum-Exclusive Special Excise Court No.-II, Katihar in connection with Kursela P.S. Case No.66 of 2024, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sunil Dutta Mishra, J) lata/- U T
