In this case, the petitioner is seeking bail in connection with Jalalgarh P.S. Case No. 134 of 2013 registered for offences under sections 376/313/323/504/201 of the Indian Penal Code.

According to the allegation, the victim was sleeping alone. The petitioner in the month of May 2011 entered into the room of the victim in the mid-night and established sexual relationship with her. In the morning, she informed to her motherin-law and other family members about the incident, but they advised to keep silence Again the petitioner established the physical relationship on different occasions with the victim and

Patna High Court Cr.Misc. No.49773 of 2015 (2) dt.06-11-2015 2/2 when she became pregnant, she was advised to go for abortion. Allegation has been made that some lady has given some local medicines that led to her abortion.

The offence has been committed in the year 2011 and the case has been filed in the year 2013.

Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Jalalgarh P.S. Case No. 134 of 2013.
