This is an application seeking anticipatory bail in connection with Katihar Complaint Case No. C.A. 1055/2013 registered for the offence punishable under Section 498-A/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner drawing my attention to the complaint petition submits that as per the complaint petition itself, the petitioner and the complainant were married more than thirty years ago. He submits that there is no truth in the allegation and the complaint case has been
Patna High Court Cr.Misc. No.32325 of 2014 (2) dt.21-01-2015 P2/2 instituted only to harass the petitioner because of matrimonial dispute between him and the complainant.
In view of the submissions as above, let the petitioner Sk. Kasim, in the event of his arrest / surrender within six weeks from today before the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount, each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar Complaint Case No. 1055/2013, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
