JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-07-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376D, 302 and 201/34 of the Indian Penal Code.

It is a case of committing the murder of the daughter of the informant after committing rape.

It is submitted by learned counsel for the petitioner that the petitioner have falsely been implicated in this case. He further submits that the petitoner is not named in the FIR and during investigation, the name of the petitioner came into light but after completing the investigation, this petitioner was not sent up for trial and finding the case prima facie has taken cognizance under Sections 302, 354B and 201/34 of the IPC and

Patna High Court CR. MISC. No.60256 of 2021(3) dt.04-07-2022 2/2 Section 8 of the POCSO Act against this petitioner. He further submits that there is no consistent material to implicate this petitioner in this case. He further submits that similarly situated co-accused has already been granted regular bail by a Coordinate Bench of this Court passed in Cr. Appeal (SJ) No. 4621 of 2018.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions JudgeVI-cum-Special Court (POCSO) Sasaram, Rohtas in connection with POCSO Case No. 17 of 2021 arising out of Sasaram (M) P.S. Case No. 130 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
