JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-12-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Pranpur P.S. Case No. 88 of 2015, registered under section 272, 273/34 of the Indian Penal Code and 47(A), 47(F) of Excise Act and 2(C)3 of Bihar Mahua Flower Act, 2006.

The prosecution case is that on secret information, the police raided the house of the petitioner, from where 60 litres of Mahua country made liquor and apparatus of preparing the liquor recovered. The petitioner was apprehended along with Kripanand Rai and Fatkan Rai.

The learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 26.09.2015.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.51510 of 2015 (2) dt.22-12-2015 case, the petitioner Dipak Rai is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Katihar in connection with Pranpur P.S. Case No. 88 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
