This application for anticipatory bail arises out of Hathauri P.S. Case N0. 192 of 2017, disclosing offences under Sections 323,379,380 of the Indian Penal Code and Sections 4,6, and 8 of the POCSO Act.

Learned counsel for the petitioner has submitted that the investigation in the case is complete and the police has found the case to be false. However, since the Court below has taken cognizance and summoned the petitioner, differing from the police report, the petitioner apprehends his arrest. He submits that since the investigation is complete, no purpose would be served, if the petitioner is taken into custody.

Considering the above submission, this application is allowed.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
