JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-08-2023 At the outset of argument learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of petitioner No.3, RAJU YADAV.

2. Prayer is allowed.

3. This anticipatory bail petition is dismissed as withdrawn against petitioner No. 3.

4. Heard learned counsel for the petitioners No. 1 & 2 and the State.

5. Petitioners apprehend their arrest in a case registered for the offence punishable under Section 308, 323 and some other ancillary Sections of the Indian Penal Code.

6. Allegation against these petitioners is of committing assault. The doctor has found simple injury. Petitioners have got clean antecedent.

7. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and nature of accusation against the petitioners, let the petitioners No. 1 & 2, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Nawanagar (Sonvarsha O.P.) PS case No. 129/ 2023, subject to conditions laid down u/s 438(2) of the Cr. P. C.
