The victim denied the story of kidnapping in her statement recorded under section 164 of the Cr.P.C and she specifically stated that she solemnized her marriage by her own sweet will with co-accused Bimlesh Kumar Rai. It appears that the learned court below rejected the prayer for bail of the petitioner only on account of controversy regarding the age of the victim.
