JUSTICE ANIL KUMAR SINHA ORAL ORDER 12-08-2021 Heard learned Counsel for the parties concerned. The petitioner has filed this writ application for fixation of his pension and payment of arrears of salary pursuant to grant of 1st, 2nd and 3rd A.C.P. (Annexure-1). Learned Counsel for the petitioner submits that the petitioner has filed a representation in this regard before respondent no. 3- the Executive Engineer, Rural Work Department, Aurangabad Division, and the respondent no. 3 may be directed to dispose the representation filed by the petitioner within a prescribed period.

Learned Counsel for the State has no objection if such direction, for disposal of the representation, is issued by this

Patna High Court CWJC No.3098 of 2021(2) dt.12-08-2021 2/2 Court.

In view of the above submission, the respondent no. 3- the Executive Engineer, Rural Work Department, Auragabad Division, is directed to consider the claim of the petitioner in accordance with law and pass a reasoned and speaking order on the representation already filed by the petitioner within a period of one month from the date of receipt/production of a copy of this order.

Needless to say that if any amount is found payable to the petitioner, the same shall be paid to the petitioner within as period of one month from the date of disposal of the representation of the petitioner.

With the aforesaid observation and direction, this writ application is disposed.
