No. 277 of 2017) registered under Sections 302, 201, 120(B)/34 of the IPC and Section 27 of the Arms Act..
The allegation in brief is that the informant's son had gone to attend a marriage ceremony in another village and this petitioner had also gone there to attend the marriage, it is suspected that this petitioner had killed the informant's son as the informant was informed by the barati.
Learned Counsel for the petitioner submits that except expressing suspicion there is no other material against the petitioner as there is no eye witness of the alleged occurrence, only some witnesses have stated that the deceased was seen along with the petitioner in the barat and in the next morning deceased's dead body was found moreover this petitioner has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Shantanu Kushwaha is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
