The petitioner has filed this writ petition for a direction to the respondent no. 3 to register the sale deed presented by the petitioner with regard to 10 Dhurs of land bearing Khata No. 114, Khesara No. 110 Area 0-3-0 Katha as draft of the sale deed was presented before the Sub-Registrar, Motihari on 24.03.2017 but the same is yet to be registered. Learned counsel for the petitioner submits that the petitioner purchased the land bearing plot no. 110, Khata No. 114, Area 0-3-0 Katha from Kamal Kishore Panday on the basis of

Patna High Court CWJC No.10073 of 2017 (2) dt.27-08-2018 2/2 Power of Attorney given by his wife Shalini Pandey. She had purchased the land from Amir Singh, son of Late Madhu Singh, who is the descendent of Ram Jeevan Singh. It is submitted that the Authority has illegally put hold on the registration of sale deed of Plot No. 110, Khata No. 115.

According to the respondent, the land belongs to Hanuman Sugar Mill and that is why the authority is not registering the deed.

Having considered the facts, I dispose of the writ petition with a direction to Sub-Registrar, District Registry Office, East Champaran, Motihari to pass an order with regard to registration of deed in accordance with law presented by the petitioner before him within three months from the date of production/receipt of this order as the Sub-registrar cannot keep the deed presented for registration in abeyance without any rhym and reasons.
