The petitioner seeks bail in connection with Morkahi P.S. Case No.45 of 2014 registered under Section 366A read with 34 of the Indian Penal Code.

It has been contended that though the alleged occurrence is said to have taken place on 08.05.2014, the FIR was registered on 27.05.2014. There is no reasonable explanation for the delay caused in instituting the FIR. It has been further contended that even the victim, whose statement has been recorded under Section 164 of the Code of Criminal Procedure, has not made any allegation of physical abuse.

Regard being had to the facts and circumstances of the

No.52414 of 2015 (3) dt.30-01-2016 2/2 case, the petitioner, namely, Sintu Kumar, who is said to be a man of clean antecedent and is in custody since 27th July, 2015, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Khagaria in connection with Morkahi P.S.Case No. 45 of 2014.
