JUSTICE AMARESH KUMAR LAL ORAL ORDER 11-03-2015 This is an application for grant of anticipatory bail to the petitioner in a case registered for the offence punishable under Sections 147, 323, 379, 498A/34 of the Indian Penal Code. Heard the learned counsel for the petitioner, State and the opposite party no.2.

The allegation against the accused including the petitioner is to have demanded Rs.50,000/- and a motorcycle as dowry and due to non-fulfillment of demand of dowry, the complainant/informant was subjected to torture and cruelty in various ways and after snatching the ornaments of the complainant/informant, she has been ousted from her marital home.

It is submitted that the petitioner is the husband of the complainant/opposite party no.2 and he wants to lead conjugal life with her with full honour and dignity.

The learned counsel for the opposite party no.2 submits

Patna High Court Cr.Misc. No.31770 of 2014 (6) dt.11-03-2015 2/2 that up-till-now the victim has not been approached. The learned counsel for the opposite party no.2 submits that the petitioner is earning outside the State and he will take back his wife, opposite party no.2 within two months.

Considering the facts and circumstances of the case, the interim anticipatory bail granted to the petitioner vide order dated 28.07.2014 is confirmed. The petitioner will remain on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in Desari P.S. Case No.232/2013 subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure and the other following conditions : 1.

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
