The petitioner, who is in custody since 14.07.2015 in connection with Patori P.S. Case no.283 of 2015, registered for the offence under Sections 420,467, 414 and 120(B)/34 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that on the basis of confessional statement of one of the accused, the petitioner's house was searched and it was alleged regarding recovery of one stolen motorcycle. It has been argued that one of the co-accused, namely, Mintu Prasad Yadav , from whose house also one stolen motorcycle was recovered, has been granted bail

Patna High Court Cr.Misc. No.52855 of 2015 (2) dt.11-12-2015 2/2 by this Court on 16.10.2015 vide Cr.Misc.No. 47130 of 2015. He submits that the petitioner's case stands on better footing than the case of Mintu Prasad Yadav and the petitioner is having clean antecedent.

Learned Addl. Public Prosecutor has opposed the prayer for bail. However, he was not in a position to distinguish the case of the petitioner from the case of Mintu Prasad Yadav. In view of facts and circumstances, let the petitioner, namely, Amarjeet Sahani @ Amarjeet Kumar Sahani be released on bail on furnishing bail bond of Rs.10,000/-( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Patori P.S. Case no.283 of 2015 on conditions that (i) one of the bailors must be blood relation of the petitioner and (ii) during trial on each and every date the petitioner shall remain physically present before the trial court. If continuously on two dates, the petitioner fails to appear without prior permission of the trial court, his bail bond shall stand automatically cancelled.
