The petitioner seeks bail in connection with Biraul P.S. Case No. 200 of 2016 registered for the offence punishable under Section 302, 304B/34 of the Indian Penal Code. Informant in his written complaint on 03.06.2016 at about 4:00 pm, has stated that his daughter was married with petitioner in the year 2013, and she remained there peacefully for six months and thereafter she was being subjected to torture for non fulfillment of demand of dowry and on 03.06.2016 at about 9:00 am, he received information on phone that his daughter has been killed by his Father-in-Law, Mother-in-Law and husband, and thereafter she has been cremated. On receiving said information he went to the matrimonial house of

Patna High Court Cr.Misc. No.6090 of 2018(3) dt.27-02-2018 2/3 his daughter and found that her daughter was being taken to Primary Health Centre on jeep, where she was declared as brought dead. It has further been alleged that her in-laws had murdered his daughter after setting her on fire. It has been contended by the learned counsel for the petitioner that the petitioner is innocent and he was not present at the place of occurrence and was residing in Mumbai, which is corroborated by the evidence of own brother of deceased, who stated that the petitioner was with him in Mumbai on the date of occurrence. It has further been submitted that the Father-in-Law and Mother-in-Law of the deceased have been granted anticipatory bail vide order dated 20.04.2017 passed in Criminal Miscellaneous No. 9036 of 2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Biraul in connection with Biraul P.S. Case No. 200 of 2016.
