The petitioner seeks bail in connection with Mashrakh P.S. Case No. 583 of 2022 instituted for the offence under Sections 272, 273, 328, 308, 304 & 120(B) of the Indian Penal Code and Sections 33 & 34 of the Bihar Prohibition and Excise Act.

AS per prosecution case, all the FIR named accused persons, including the petitioner were engaged in illegal liquor trade. It is alleged that the accused persons supplied poisonous liquor causing death of several persons. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14-06-2025. Petitioner

Patna High Court CR. MISC. No.47717 of 2025(3) dt.03-09-2025 2/3 bears four criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Nothing has been recovered from the possession of the petitioner. Petitioner is not named in the FIR. Name of the petitioner has cropped up in this case during investigation and except suspicion, nothing is against the petitioner. There is no compliance of Section 103 of the BNSS, 2023. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is fervently submitted that petitioner along with other co-accused allegedly supplied poisonous liquor causing death of 27 people. Bail of other co-accused has been rejected by a Co-ordinate Bench of this Court vide order dated 05-05-2023, passed in Cr. Misc. No. 11674 of 2023.

Considering the aforesaid facts and circumstances of the case and taking into consideration the nature and gravity of the offence, this Court at this stage, is not inclined to grant bail to the petitioner. Prayer for grant of bail to the petitioner is hereby rejected.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments.
