JUSTICE RAJIV ROY ORAL ORDER 17-01-2023 Heard Mr. Shambhu Sharan Singh, learned counsel for the petitioner and Mr. Rajnikant Singh, learned counsel for the informant as also Mr. Satya Nand Shukla, learned APP for the State.

The petitioner apprehends his arrest in connection with Complaint Case No.450(C) of 2020 instituted under Sections 498A IPC and 3⁄4 of Dowry Prohibition Act. As per the prosecution story, the lady has alleged that the petitioner who is a Probationary Officer tagged nuptial knots with her, the same was a love marriage but later his family

Patna High Court CR. MISC. No.49944 of 2022(4) dt.17-01-2023 2/3 members started demanding dowry stating that the boy being a Probationary Officer, dowry is essential. Accordingly, the FIR was lodged.

Learned counsel for the petitioner submits that a Divorce suit has already been filed and this case is nothing but a counterblast to the same. He however submits that taking into account the fact that till an order is passed by the concerned court, she is legally wedded wife of him and as such he also has a duty towards her.

He thus submits that the petitioner will be paying Rs.20,000/- per month to the lady till an order is passed by the competent court after which this order may merge with the final order.

Learned counsel for the informant on the other hand submits that since it was a love marriage, she still wants to live with him and will try her best that the marriage is saved. In view of the fair submissions put forward by both the parties, this court is inclined to grant him privilege of anticipatory bail with the aforesaid condition that he will paying Rs.20,000/- per month beginning January, 2023 and from February onwards, he will be paying by 10th of the said month. This order will merge with the final order passed by the Family

Patna High Court CR. MISC. No.49944 of 2022(4) dt.17-01-2023 3/3 Court in the case filed by the petitioner.

Failure to abide by the undertaking given here, the informant will be free to take appropriate steps for the cancellation of his bail. The learned counsel for the informant will be providing the bank account number of the lady to the learned counsel for the petitioner.

Let the petitioner be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each in connection with Complaint Case No.450(C) of 2020 to the satisfaction of learned A.C.J.M., IIIrd, Barh, Patna, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
