JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-08-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1170 of 2016, Trial No. 942 of 2019, disclosing offences under Sections 461, 469, 120B of IPC.

Complaint case shows that allegation of 0.08 decimal area of Khata No. 1006, Khasra No. 5028 is sold by one Ranjit Kumar to the complainant and she was given possession over the same, but later on, said land has been sold by the co-accused to petitioner no.1 and petitioner no.2 is the husband of petitioner no.1 and they are not allowing the complainant to take possession of the land.

Patna High Court CR. MISC. No.48857 of 2019(2) dt.06-08-2019 2/2 Submission of the learned counsel for the petitioners is that they are only second purchasers. Allegation is against coaccused Ranjit Kumar that he sold the land to the complainant and has been taken by the father of Ranjit Kumar to the petitioners.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Sub Judge 13th -cum- A.C.J.M.4, Muzaffarpur, in connection with Complaint Case No. 1170 of 2016, Trial No. 942 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
