2. Prayer for bail of this petitioner was earlier rejected by this court vide order dated 01/12/2021 passed in Cr. Misc. No.39579/2021.

3. Learned counsel appearing for the petitioner submits that till date only charge has been framed in this and similarly situated accused Raushan Yadav has already been granted bail by this court vide order dated 21.06.2023 passed in Cr. Misc. No. 21530/ 2023 (Annexure-4). Petitioner is in custody since 17/08/2019.

4. Learned counsel appearing for the State opposes the prayer for bail.

5. Considering the facts of the case, period of custody of the petitioner and the fact that similarly situated co-accused

Patna High Court CR. MISC. No.51866 of 2023(2) dt.09-08-2023 2/2 has already been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Saharsa in connection with Saharsa Sadar PS case No. 711/ 2019.
