Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-09-2021 Heard the learned counsel for the petitioners and the learned APP for the State.
The petitioners seek bail in anticipation of their arrest in connection with Mednichouki P.S. Case No. 83 of 2020 instituted for the offences under Sections 341, 342, 323, 307, 353, 379, 332, 333, 147, 148 and 427 of the Indian Penal Code.
The F.I.R. has been lodged against seventeen named accused persons and about thirty five unnamed
Patna High Court CR. MISC. No.5787 of 2021(2) dt.17-09-2021 2/3 accused persons. So far as the petitioners are concerned, they are not alleged to have done anything. Some of the similarly situated persons against whom there is no allegation of any overt act have been granted bail by the court below.
The learned counsel for the petitioners has submitted that except for their having been named in the F.I.R, there is no other material to connect them with the offence. The petitioners are landless agricultural workers and they have been made accused in this case because of local village politics.
Regard being had to the vague nature of accusation against the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Lakhisarai, in connection with Mednichouki P.S.
