Name withheld aged about 14 years daughter of informant, did not return after meeting nature's call on 28.04.2017 at about 8.00 PM, informant had gone in search of her and during course thereof, came to know that his co-villager, Bipin Chaudhary has enticed her away. Then thereafter, he had gone to the place of petitioner and requested him to get her daughter produced whereupon, he took five days' time and even thereafter, the victim has not been handed over to him. On the other hand, informant was scolded by the petitioner along with others. From the statement recorded under Section 164, the victim had disclosed that Pappu Chaudhary, Tempoo Chaudhary, Vijay Chaudhary and one more person to be responsible for her kidnapping and carrying
Patna High Court Cr.Misc. No.5835 of 2018 (2) dt.01-02-2018 her to Delhi. Both two appears to be contradictory to each other in the background of the fact that when informant had met with the petitioner on the day of incident itself then in that event, there was no possibility for the petitioner to have joined the victim up to Delhi.
That being so, petitioner, Vijay Shankar Chaudhary is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-1st, Rohtas at Sasaram in Dinara PS Case No. 121/2017.
