Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 406, 420, 506 and 34 of the Indian Penal Code, registered in connection with Bettiah Town P.S.Case No. 553 of 2020 (G.R.No. 4216 of 2020). The learned counsel for the petitioner has submitted that FIR shows that co-accused Krishna Prasad Jaiswal, the father of the petitioner, took money from the informant to whom

Patna High Court CR. MISC. No.59730 of 2021(2) dt.12-07-2022 2/3 co-accused Manoj Prasad Jaiswal introduced with the informant. The petitioner has no role in that transaction. He has submitted further that the bank account no. 1017000299202, as mentioned in the FIR, is not in the name of the present petitioner. The allegation against co-accused Manoj Prasad Jaiswal @ Manoj Kumar is that he introduced the informant with co-accused Krishna Prasad Jaiswal and he has been granted regular bail. He has also submitted that co-accused Pratima Devi and Suman Kumari @ Suman, on similar allegation, have been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc. No. 39710 of 2021 and Cr.Misc. No. 39545 of 2021 respectively.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S.Case No. 553 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.
