The petitioner is apprehending his arrest in connection with Wazirganj P.S.Case No.97 of 2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excie (Amendment) Act, 2018.

Allegation against the petitioner is about recovery of 17 cane of 500 ml. of foreign liquor has been recovered from the under-constructed house of the petitioner.

Submission of the learned counsel for the petitioner is that it is a under-constructed house of the petitioner and it is not a case that the petitioner is residing in the house. Further, he has no criminal antecedent.

Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the recovery is from a under-constructed

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the to the petitioner to surrender and make prayer for regular bail, which will be considered on the basis of the materials available on the record and if possible to be disposed of on the same day.

With the aforesaid direction, this application is disposed of.
