The petitioners apprehend their arrest in connection with Jagdishpur P.S. Case no. 251 of 2021 registered under sections 307, 379 and other allied section of the Indian Penal Code.
Learned counsel for the petitioners submits that one month prior to the present occurrence, petitioners had filed Jagdishpur P.S. Case no. 206 of 2021 and after that for making pressure to compromise the case of the petitioners, present case
Patna High Court CR. MISC. No.62826 of 2021(2) dt.14-06-2022 2/2 has been lodged after thought and in the present case, two persons sustained injuries and most of the injuries are opined to be simple in nature and the petitioners have got no criminal antecedent.
Learned APP opposes the prayer for anticipatory bail. Heard both sides and perused the FIR as well as injury reports of the informant and two other injured persons. As per allegation, petitioners came at the house of the informant and started abusing and assaulting him by means of lathi, rod and when his son came and intervened, he was also assaulted by the accused persons. As per injury report of the informant, 3rd rib of left side was found fractured and the same was opined to be grievous in nature and two persons also are said to be injured and the case is under investigation.
Considering the nature of allegation, in my view, petitioners do not deserve anticipatory bail and accordingly, their prayer for anticipatory bail stands rejected. (Shailendra Singh, J) s.hassan/- U T
