The petitioner seeks bail in connection with Baligaon P.S. Case No.61/2015 registered under Sections 272, 273 of Indian Penal Code and Section 47(a) of Bihar Prohibition and Excise Act, 2016.

37.965 liters of foreign liquor is said to have been recovered from the possession of Sujit Kumar and Md. Wahid, who disclosed the name of petitioner as their accomplice. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner was not

Patna High Court Cr.Misc. No.7845 of 2018 (2) dt.13-02-2018 2/2 apprehended on the spot. He has been falsely implicated in this case by aforesaid accused persons due to animosity. He has no concern with the seized liquor and has been languishing in custody since 11.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Vaishali at Hajipur, in connection with Baligaon P.S.
