10-12-2015 Heard Sri Pankaj Kumar Sinha, learned counsel, who was assisted by Mr. Md. Musowir, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor. Two petitioners, who are lady and in custody in Kadwa (Balia Belone) P.S. Case No. 141 of 2015 registered for the offence under Section 307 & other allied sections of the Indian Penal Code and subsequently section 302/34 of the I.P.C. was added, have prayed for grant of bail.

It was submitted by learned counsel for petitioners that accusation of giving knife blow was against one co-accused. Only there is allegation against the petitioners that at the time of occurrence, both petitioners were instigating the main accused to

Patna High Court Cr.Misc. No.52779 of 2015 (2) dt.10-12-2015 2/2 kill the informant. It has further been submitted that petitioner no. 1 is in custody with her child in lap and petitioner no. 2 is an old lady.

In view of the fact that both the petitioners are lady and there is no direct accusation against both of them, let both the petitioners namely Gulesha Khatoon and Most. Samidan @ Samidan Khatoon be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Katihar, District - Katihar/concerned court in connection with Kadwa (Balia Belone) P.S. Case No. 141 of 2015.
