The present petition has been filed under Section 24 of the Code of Civil Procedure, 1908 with a prayer to transfer Matrimonial Case No. 988 of 2015 from the judgeship of Patna to the judgeship of Gaya.
It was submitted by learned counsel for the petitioner that marriage of the petitioner with opposite party was solemnized in the year 2009 at Bankipur Club, Patna and from the wedlock, she was blessed with a child. Subsequently, she was ousted and thereafter, the present divorce case has been filed by the husband. It has been argued that for petitioner, being lady and having a
Patna High Court MJC No.443 of 2016 (2) dt.23-02-2017 2/2 child, it would be difficult to participate in a proceeding at Patna. In the petition, nothing has been indicated that even after being ousted, any action was taken by the petitioner against her husband or whether she has filed any maintenance case. However, after perusing the ground set forth in the matrimonial suit (copy of the same at Annexure '1'), wherein serious allegation has been levelled against the petitioner, the Court is of the opinion that in such situation, there is no need to pass any favourable order.
The petition stands dismissed.
