The petitioners seek bail in connection with Dawath P.S. Case no. 148 of 2017 registered under Sections 30(a)/34 of Bihar Prohibition & Excise Act-2016.

161.200 lts. of country made liquor is said to have been recovered from the bamboo cluster which is said to have been hidden by the petitioners.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their conscious physical possession. They have been falsely implicated in the case at the instance of their enemies. They have no concern either with the seized liquor or with the place

In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge (Excise), Rohtas at Sasaram in connection with Dawath P.S. Case no. 148 of 2017.
