JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant for non-fulfillment of the dowry demand and disposing of the dead body.
It is submitted by learned counsel for the petitioner that as per own admission of the informant that the marriage was performed in the year 2002 when the victim died in the year 2015, the case does not come within the purview of Section 304B of the IPC. The accusation is omnibus and general against the entire inlaws family and the petitioner claims to be separate from the
Patna High Court Cr.Misc. No.3537 of 2016 (2) dt.22-01-2016 2/2 husband of the victim. Moreover, the informant has retracted from his initial version and filed a petition to that effect before the learned court below, the same has been brought on record as Annmexure-2 to the petition.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Arwal in connection with Kurtha P.S. Case No. 68 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
